Your item is EAR99 or there is no "X" in the box so you do not need an export license, right?
If I had a penny for every time an exporter said, "no need" Export Compliance "- our products are EAR99" I am retiring now. And if I had a nickel for every time I heard "we do not need an export license because there is no" X "in the box so that country, which had to be scrapped and have much more money in my 401K.
I refer to the general prohibitions of Regulation 10.4 of Export Administration (EAR). I think, or at least hope, that exporters of articles in the Commerce Control List (Supplement No. 1 to Part 774) that require an export license are, for the most part, aware General prohibitions 1-3 and carry out its screening license accordingly. 1-3 General prohibitions ban the export of certain articles of the FTC to countries listed in the table of Commerce of the country in Supplement No. 1 to Part 738.
What many exporters do not realize is that the general prohibitions are only 1-3 that the first steps in determining licensing and enforcement of U.S. export laws and regulations. 4-10 General prohibitions include bans on certain activities not permitted without authorization (ie, licenses) of SIB, and these prohibitions apply to all items subject to the EAR unless specified Otherwise (Part 736.2 (b) (4) to (10) of the EAR).
General Prohibition 4 states that may not take any action that is prohibited by an order for refusal issued under Part 766 of the EAR. Denial orders prohibit many actions in addition to direct exports of the person who denied privileges export. This prohibition applies to all items subject to the EAR, ie both items on the CCL and within EAR99. You are responsible for ensuring that their transactions involving a person who refuses export privileges does not violate the terms of the order. Orders denying export privileges is published in the Federal Register when issued and are legal documents in conformity with its terms. Unless otherwise indicated, the general licensing requirements Ban May apply to all items subject to the EAR, ie both elements of the CCL and within EAR99. General Prohibition 6 prohibits exports or reexports to embargoed destinations without a license or license exception authorized under Part 746. General prohibition 8 forbids the export or reexport of an article transit through the following countries without a license or permit or license exception if an exception would require a direct export to that country: Albania, Armenia, Azerbaijan, Belarus, Cambodia, Cuba, Georgia, Kazakhstan, Kyrgyzstan, Laos, Mongolia, North Korea, Russia, Tajikistan, Turkmenistan, Ukraine, Uzbekistan and Vietnam. General Prohibition 8 applies to all items subject to the EAR that includes both elements of the CCL and within EAR99.
Ban General 9 prohibits the violation of the terms or conditions of the license or license exemption issued under or made a part of the EAR, and the violation of an order issued under or made a part of the EAR. There are exceptions to this general prohibition license. Supplements Nos. 1 and 2 to Part 736 to establish some general orders and orders administrative.
10 General prohibition prohibits any person from proceeding with a transaction with knowledge that a violation of the EAR has occurred or is about to occur. It also prohibits related shipping, financing and other services. This prohibition applies to all items subject to the EAR, again the two elements of the CCL and within EAR99. Obviously there are exceptions to this prohibition General License.
I think the general prohibitions are well summarized by the title of a recent seminar in Orlando BIS – "You may need an export license to send a pen to Canada."
